Terms of Service
What you can expect from LinkScout, what we expect from you, and who is responsible for what. LinkScout is sold to businesses only.
1Who this agreement is with
These terms are an agreement between you (“you”, “your”, the customer) and Pavlovic Media, a sole proprietorship of Dimitrije Pavlovic, Fischerweg 4, 4222 Zwingen, Switzerland (“we”, “us”, “LinkScout”).
By creating an account or using the service you accept these terms, the Privacy Policy and the Data Processing Agreement. The Data Processing Agreement is part of this agreement and applies to every account.
2Business customers only
LinkScout is offered exclusively to businesses, sole traders, and people acting in the course of a trade or profession. It is not offered to consumers. By opening an account you confirm that you are acting for business purposes and that you are authorised to bind the organisation you are acting for.
Because this is a business-to-business service, statutory consumer protections - including any right of withdrawal for distance contracts - do not apply.
3What LinkScout does
LinkScout is software that helps you earn backlinks. On your instruction it:
- searches for websites that already rank for the keywords you choose;
- finds a likely contact at those websites;
- writes outreach emails and sends them from a mailbox you connect;
- follows up, reads replies, and classifies them;
- drafts a guest post when a site accepts;
- checks the resulting links and tells you when one disappears.
Parts of the service use large language models and other automated systems. Their output is not always correct. You are responsible for reviewing anything LinkScout produces before it is published or acted on.
4Your account
You need an account to use LinkScout. Keep your credentials and API keys secret; you are responsible for everything done through your account, including by anyone you give access to and by any tool you connect through our API. Tell us at support@linkscout.io if you think an API key or account has been compromised, and revoke the key in your settings.
5The mailbox you connect
LinkScout sends from a mailbox you connect and authorise - your address, your domain, your sending reputation. We do not send from our own infrastructure on your behalf, and we do not send outreach in our own name.
You authorise us to send, read, label and mark as read the messages needed to run your campaigns. We never delete your mail, never archive it, and never alter the content of a message you did not create through the service.
Sending cold email carries risk to your domain and mailbox reputation. LinkScout paces sending, warms new mailboxes gradually and enforces daily limits to reduce that risk, but it cannot remove it. If your domain is blocklisted, throttled or your mailbox suspended by your email provider, that is a risk you accept when you connect it.
6Your outreach, your responsibility
This clause matters more than the rest. LinkScout is a tool that acts on your instruction. You choose the websites, the keywords and the message; you decide who is contacted. You are the sender of every email that leaves your mailbox through LinkScout, and you are responsible for it.
In particular, you are responsible for:
- having a lawful basis for contacting each recipient under the law that applies to them - which may include the GDPR, the Swiss Federal Act on Data Protection, the Swiss Unfair Competition Act, the US CAN-SPAM Act, Canada’s CASL and others;
- giving recipients the information the law requires about where their data came from and how it is used, including any notice owed under Article 14 GDPR;
- the accuracy and the content of what is sent, including anything a language model drafted and you approved;
- keeping your postal address in settings accurate - it appears in every email, and several jurisdictions require it.
Turning on automatic approval does not change any of this. Automatic approval is a setting you configure, and email sent under it is sent on your instruction exactly as if you had clicked approve.
7Acceptable use
You may not use LinkScout to:
- send email to anyone who has asked not to be contacted, or attempt to work around the suppression list;
- send deceptive, misleading or falsely-attributed messages, forge headers, or misrepresent who you are;
- promote unlawful goods or services, malware, or content that infringes a third party’s rights;
- buy, sell or exchange links in a way that breaches the published guidelines of a search engine, or otherwise use the service to manipulate search results by means we would not want to explain publicly;
- upload or process special category personal data, or data about people you know to be children;
- resell, sublicense or provide the service to third parties as your own, or use it to build a competing product;
- circumvent plan limits, rate limits or sending caps, or place unreasonable load on the service.
We may suspend or close an account that breaches this clause, immediately and without refund, and we will tell you why.
8Plans, fees and refunds
Plans, prices and limits are shown on the pricing section of our website and in your account. Fees are stated in US dollars, billed in advance by our payment provider, and renew automatically each month until you cancel.
New accounts may start with a free trial. If you do not cancel before the trial ends, the plan begins and the first payment is taken. We email you before that happens.
You can cancel at any time from your account. Cancellation stops the next renewal and takes effect at the end of the period you have already paid for; the service keeps working until then.
Fees are non-refundable except where required by law. That includes partial months, unused sending allowance and periods during which you chose not to use the service.
Founding prices are locked to the account that took them and do not change for as long as the subscription remains active and uninterrupted. A founding place is consumed when the subscription is created, including during a trial, and is not returned if the subscription is later cancelled, downgraded or ends in non-payment.
We may change prices. We will give at least 30 days’ notice by email before a change affects you, and a founding price is not affected.
9Who owns what
You keep everything you put into LinkScout and everything it produces for you - including outreach copy, guest post drafts and reply drafts. To the extent we hold any rights in that output, we assign them to you. You may use it however you wish.
We keep all rights in the service itself: the software, the interface, the models and prompts we build, our name and our marks. Nothing here transfers those to you. You get a non-exclusive, non-transferable right to use the service while your subscription is active.
Language models can produce output that resembles their training data or someone else’s work. We do not warrant that generated content is original or that publishing it will not infringe a third party’s rights. Review before you publish.
10Personal data
How we handle personal data is described in the Privacy Policy.
For the personal data of the people you contact - the contacts LinkScout finds, and the content of the messages you exchange with them - you are the controller and we act as your processor. The Data Processing Agreement sets out that arrangement, including our sub-processors and our security obligations.
11Availability and results
We aim to keep LinkScout available and working, but we do not promise uninterrupted service. We may take it down for maintenance, and parts of it depend on third parties - search providers, model providers, email providers - whose availability we do not control.
We do not guarantee results. We do not guarantee that any website will reply, accept a guest post, publish a link, keep a link, or that any link will improve your rankings or cause your product to appear in any search engine or AI assistant. Search results depend on factors nobody outside those companies controls. Anything on our website describing past results describes our own projects and is not a promise about yours.
12Third-party services
LinkScout works with services provided by others - among them your email provider, search data providers, model providers and our payment provider. Those services have their own terms, and their acts and outages are not within our control. A list of the providers we use is at Sub-processors.
13Suspension and termination
You may close your account at any time. We may suspend or close your account if you breach these terms, if payment fails and is not resolved, if we are required to by law, or if your use puts the service or other customers at risk. Except where the breach is serious or urgent, we will contact you first.
When an account ends, access ends. Export anything you want to keep beforehand. What happens to your data afterwards is described in the Privacy Policy under retention. Suppression records are kept permanently and are not deleted with an account - see clause 7 and the Privacy Policy for why.
14Warranties
The service is provided as it is and as it is available. To the fullest extent permitted by law, we exclude all implied warranties, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be error-free or that defects will be corrected.
15Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, for wilful misconduct or gross negligence, or for anything else that cannot lawfully be limited.
Subject to that, and to the fullest extent permitted by law, our total liability to you arising out of or in connection with this agreement, in any twelve-month period, is limited to the fees you paid us in the twelve months before the event giving rise to the claim.
We are not liable for indirect or consequential loss, for loss of profit, revenue, goodwill, business opportunity, search rankings or data, for damage to your domain or mailbox reputation, or for the acts of the people you choose to contact.
16Indemnity
You will indemnify us against claims, losses and reasonable costs arising from your use of the service in breach of these terms, and in particular from outreach sent through your account - including any claim by a recipient, a regulator or a third party concerning the lawfulness of that outreach or the content of what was sent.
17Changes
We may change the service, and we may change these terms. If a change materially reduces what you get or increases what you owe, we will tell you by email at least 30 days beforehand. Continuing to use LinkScout after a change takes effect means you accept it; if you do not, cancel before then.
18General
If any provision of these terms is held unenforceable, the rest stays in force and the unenforceable part is replaced by one that comes closest to its intent.
You may not transfer this agreement without our consent. We may transfer it as part of a sale or reorganisation of the business, and will tell you if we do.
These terms, the Privacy Policy and the Data Processing Agreement are the whole agreement between us about the service.
19Governing law and jurisdiction
This agreement is governed by the substantive law of Switzerland, excluding its conflict of law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods.
The exclusive place of jurisdiction is the courts of Basel-Landschaft, Switzerland.
